Dan Dolan was recently featured in the Daily Business Review’s  Profiles in Law” section. The article, written by Litigation Reporter Raychel Lean, describes Dan’s tenacious approach to practicing law and the factors that have contributed to his success as a lawyer and contributing member of the South Florida community. From his early days interning for the Miami-Dade Public Defender’s Office to representing victims of serious injury at DDRB, Dan has spent his entire career taking on the most formidable opponents and turning fear into a passion for winning. “As a trial lawyer,” Dan said, “you quickly identify what you fear, and it either makes you turn and run, or accept the reality that you have no choice but to be relentlessly passionate about winning.” With that passion, Dan has helped many injured victims get back on their feet (sometimes literally) by efficiently and aggressively representing them, even against difficult odds.

One such case this year was a products liability lawsuit against one of the largest manufacturers of firefighting equipment. Although the case settled confidentially the day before jury selection, it also resulted in the manufacturer redesigning its training device and instruction manuals to prevent future accidents.

In addition to focusing his practice on helping injured victims in Florida, Dan also serves on the Board of Trustees of St. Thomas University and is membership chair for the Miami Chapter of the American Board of Trial Advocates.  Read Full Article.

ATTORNEY ROSENBLUM HELPS WOMEN RECEIVE $2.5 MILLION VERDICT

BUT HINTS AT HOW TRICKY TOBACCO CASES CAN BE

Attorney Randy Rosenblum teamed up with Jacksonville lawyers Richard Lantinberg and Allen Jay Plotkin of the Wilner Firm to hit Philip Morris USA INC. , a tobacco company, with a $2.5 million verdict for the daughter of Guy Cuddihee who died in 1994 from lung cancer. The jurors decided against punitive damages. This decision seemed to stem from the plaintiff showing no signs of quitting when he was alive.  Attorney Rosenblum explains further how jurors have a prejudice against smokers and that cases like this face an uphill battle when looking for punitive damages to be awarded from the jury.

MANUEL DOBRINSKY HELPS REACH A $1.2 MILLION SETTLEMENT

Attorney Manuel L. Dobrinsky and Attorney Andrew Mitchell Moss of Kutner, Rubinoff & Moss of Coconut Grove, were instrumental in helping Marcy Romeo reach a settlement of $1.2 million from the Broward Sheriff’s Office. Marcy Romeo is the ex-wife of Douglas Bates, who was a partner of disgraced Fort Lauderdale attorney Scott Rothstein who allegedly arranged the false arrest of her in 2009 for trumped-up drug charges as requested by Mr. Bates. Ms. Romeo claimed that she was handcuffed, strip-searched and threatened by Broward County officers during her false arrest. After the defense saw the plaintiff’s case, the defense decided to settle.

RANDY ROSENBLUM RECOGNIZED AS ONE OF SOUTH FLORIDA’S MOST EFFECTIVE LAWYERS IN 2019

 

Randy Rosenblum has been recognized by the Daily Business Review as one of South Florida’s Most Effective Lawyers in 2019 for bringing positive results for his personal injury clients. Attorney Rosenblum was instrumental in helping win a first of its kind verdict in a Massachusetts smoker’s tobacco litigation case. Randy worked alongside Gordon & Partners, a Boston based Public Health Advocacy Institute, to help find the tobacco company, R.J. Reynolds Tobacco and it’s co-conspirators, liable for the death of Pamela Coyne in 2016.

“Eric has been an integral part of our firm since we started and given his accomplishments both in the courtroom and in our community, his new role strengthens our brand.”  said co-founding partner Dan Dolan.

Bluestein concentrates his practice in personal injury, automobile accidents, medical malpractice, consumer fraud, premises liability, wrongful death litigation, insurance bad faith and commercial litigation. He has tried numerous cases and obtained verdicts and settlements   which have resulted in millions of dollars for his clients. 

Bluestein will serve as President Elect of the Miami-Dade Trial Lawyers Association for 2020-21 and is a Past President of the Dade County Bar Association Young Lawyers Section. He has been recognized by Florida Trend’s Magazine as a Florida Legal Elite Up and Comer annually since 2011 and has been honored as a Rising Star in Super Lawyers Magazine consecutively since 2013.

Randy Rosenblum Obtains $17 Million Verdict in MA Tobacco Case

On May 31, 2019, Dolan Dobrinsky Rosenblum Bluestein Partner, Randy Rosenblum, along with Gary Paige and Cassandra Lombard of Gordon & Partners, and Andrew Rainer and Meredith Level of the Public Health Advocacy Group, obtained a $17 million verdict against R.J. Reynolds Tobacco Company after a month long trial in Lowell, Massachusetts. At trial, the jury found for the Plaintiff on his claims for Breach of Warranty (product defect), Conspiracy and Negligent Marketing.  The jury awarded in excess of $6 million for compensatory damages and medical bills, and in excess of $11 million in punitive damages, for a total verdict that slightly exceeded $17 million. Daily Business Review Reports Opposing Counsel DQ’d From Case for Unfair Informational Advantage

Kevin McCrea, a lieutenant firefighter with Miami-Dade County Fire Rescue, filed suit against the defendants in 2013, alleging he suffered severe burns after a Kidde Fire Trainer product ignited during a safety course facilitated by defendant Maley in November 2011. The complaint contended Kidde were negligent for a design defect in the item and liable for McCrea’s injuries.

Daily Business Review has recently reported that the defendant’s firm’s petition for writ of certiorari was declined by Forida’s Third District Court of Appeal. The firm had previously been removed from the case by a trial court after it failed to disclose to plaintiff attorney Dan Dolan that it had received a document sent to it in error. Instead, court records show it got — and kept — a handwritten statement the plaintiff had meant to send his lawyers, but accidentally had transmitted to the other side.

Randy Rosenblum & Co-counsel Secured Two of Florida’s Top 10 2017 Product Liability Verdicts

Randy Rosenblum was part of legal teams that obtained the #1 and #8 largest product liability awards in a list recently compiled by TopVerdict.com. Randy and co-counsel obtained $36 million in compensation for the widow of a smoker. In another big victory, Randy helped produce a $3 Million verdict against a major tobacco company. Randy was one of the only attorneys to appear twice on the list of top verdicts in the state of Florida. DDRB Client Obtains $7.5M Verdict by Florida Jury in Lung Cancer Case

Dolan Dobrinsky Rosenblum Bluestein LLP Partner, Randy Rosenblum, along with co-counsel, obtained a $7.5 million verdict against RJ Reynolds Tobacco Company for the son of a smoker who died of lung cancer.  Floyd Olson was born in 1937 and smoked between 2-4 packs per day of Camel unfiltered cigarettes for over 40 years until he was diagnosed with and died of lung cancer in 1996. The case was originally brought for both Mr. Olson’s son, Michael, and his surviving spouse, Lorraine. However, after the first trial of this case resulted in a mistrial in 2017, Lorraine passed away and left Michael as the only survivor of Mr. Olson’s Estate who could bring a claim for damages under Florida law. Michael was 21 years old at the time of his father’s death.

This is the third Plaintiff’s verdict obtained by Mr. Rosenblum in tobacco cases this year and, since 2017, DDR has obtained over $50 million in verdicts in tobacco cases.

DDRB Client Awarded $3M in Damages by Port St. Lucie Jury in Lung Cancer Case

Mrs. Burgess, on behalf of Mr. Burgess’ Estate, sued the manufacturer of Pall Mall and Winston brand cigarettes, RJ Reynolds Tobacco Company. After a two and one half week trial in Port St. Lucie, the jury found for Mrs. Burgess on her claims of negligence, strict liability, fraudulent concealment and conspiracy to commit fraudulent concealment. The jury awarded Mrs. Burgess $3 million in damages.

Jury Awards DDRB Client $4M in Damages in Lung Cancer Case

A jury awarded Alachua County resident, Jo Freeman, $4 million in damages, after her husband, David, died of lung cancer. He had smoked Philip-Morris cigarettes for thirty years. The jury found Philip-Morris was 60% responsible for David Freeman’s death.
