Jury Returns Over $1 Million Verdict in Nursing Home Negligence Case 

Dolan Dobrinsky Rosenblum Bluestein, LLP is pleased to announce that co-founding partner, Manuel L. Dobrinsky along with co-counsel Carlos Jimenez, Mark B. Hart and Alexa Delgado of Jimenez, Hart, Mazzitelli Mordes, obtained a verdict in excess of $1 million for the family of nursing home victim, Carlos Ruiz. 

In March 2020, The Estate of Carlos Ruiz sued Palm Garden of Aventura, LLC and Palm Healthcare Management, LLC. Mr. Ruiz, an 84-year-old man with advanced dementia and Alzheimer’s was admitted to Palm Garden of Aventura, LLC with a diagnosis of functional decline. While in the facility he developed a pressure ulcer on his sacrum that became infected and ultimately led to his death.  

Following a seven-day trial in Miami-Dade County, Florida before the Honorable Judge William Thomas, the jury awarded Mr. Ruiz’s Estate $1,112,481.92 in economic and pain and suffering damages.  

The Defendants contended that Mr. Ruiz entered their facility in a very debilitated state and that the pressure ulcer that he developed was unavoidable. However, the jury found Palm Garden of Aventura, LLC to be 80% and Palm Healthcare Management, LLC to be 20% at fault for the negligence which led to Mr. Ruiz’s injuries.

He is the Immediate Past-Chair of the Board of Directors of Legal Services of Greater Miami which provides free civil legal services for the low-income communities of Miami-Dade and Monroe Counties and is recognized as one of the most outstanding legal services programs in the state. 

Dobrinsky also serves on the Professionalism panel for the Eleventh Judicial Circuit, is an instructor for the National Institute of Trial Advocacy, a member of ABOTA, and has served on the Ad Hoc Committee on Attorney Admissions, Peer Review and Attorney Grievance for the Southern District of Florida. He is a Past President of the Miami-Dade Justice Association and has served on the Board of Directors of the Florida Justice Association.
