Pompano Beach Car Accident Statistics

Accidents are common in Pompano Beach. According to the Florida Department of Highway Safety and Motor Vehicles, Broward County experienced:

  • 40,773 crashes in 2022
  • 274 fatalities from all car accidents in 2022
  • 23,663 car accident injuries in 2022

Alarmingly, Broward County also experienced 12,535 hit and run accidents that year, which resulted in 44 fatalities and 2,472 injuries. Fleeing the scene is flatly against the law—but that doesn’t stop thousands of motorists from fleeing.

Accidents were consistently high through the year, with each month experiencing at least 3,000 collisions. Motorists should always be fully aware of their surroundings when driving around and reach out to our firm if they are injured.

Types of Car Accidents We Accept

Dolan Dobrinsky Rosenblum Bluestein, LLP, can help anyone hurt in the following crashes:

  • Rear-end collisions. This common fender bender involves one car slamming into the car in front of it, often because the driver was tailgating or distracted. Occupants can be thrown forward and suffer whiplash, back strain, and concussions, among other injuries.
  • Rollovers. It’s scary when a car flips onto its side or hood. Typically, a rollover happens because of an accident, or something causes the vehicle’s weight to shift suddenly. Anyone who is not wearing a seat belt could suffer devastating, often fatal injuries.
  • T-bones. We see these wrecks all the time at intersections. One motorist fails to yield and crashes into the side of another car. Occupants suffer a full range of injuries, including fractures, neck injuries, and head injuries.
  • Multiple vehicle collisions. These pile-ups are common on the freeway, where traffic is congested. One accident sets off a chain reaction, and suddenly dozens of cars are involved in a crash. Because of congestion, victims might wait hours for emergency medical personnel to reach them.
  • Single-vehicle accidents. Some accidents occur because of a road defect or a near-miss driver forces you to take defensive action. We can help anyone make a claim for an accident involving only one wrecked car.
  • Drunk driving accidents. Drunk driving is a serious problem. Broward County experiences about 10 or more deaths each year from drunk driving, and dozens of other motorists are injured. We can sue the drunk driver and possibly others.
  • Fatal car accidents. Surviving family members might bring a wrongful death lawsuit based on a car crash. Contact our Pompano car accident lawyer to discuss.

How to Obtain PIP Benefits

Florida continues to be a no-fault state. This means that accident victims first turn to their own insurance for compensation after a car accident. Our state requires that anyone registering a car have at least $10,000 in personal injury protection benefits, called PIP insurance. These are no-fault benefits, so you can use them to cover up to 80% of medical bills and 60% of lost wages up to the policy limit, regardless of fault.

Although PIP benefits are convenient, there are some facts to keep in mind. First, you need to receive medical treatment within 14 days of the accident. If you don’t, then you won’t be able to use PIP benefits for your accident. Second, you won’t receive full benefits under your policy unless you suffered an “emergency medical condition” as defined by Fla. Stat. § 627.732 and a doctor attests to that fact.

If you don’t have PIP insurance benefits, you might be covered under a family member’s policy. You should reach out to our law firm to discuss.

Suing for Compensation

Someone who suffers a serious injury might sue the at-fault driver by stepping outside the no-fault system. One of our Pompano Beach car accident lawyers can discuss your odds of receiving compensation for various financial and non-financial losses.

Most of our clients request money for:

  • Medical care for injuries. Your injuries could require surgery, rehabilitation, pain management, or prescription drugs. You should seek compensation to cover all past and future medical care.
  • Property damage, including car damage. An accident could wreck your car and damage any other property inside. Your pets are considered property, for example. If they are injured or killed, you can seek compensation.
  • Lost income. Serious injuries keep our Pompano Beach clients away from work. Rehab and treatment are full-time jobs, and you can lose considerable income due to the accident. We seek compensation for any lost wages.
  • Pain and suffering. Florida PIP benefits won’t pay anything for pain and suffering. If we can sue, we will seek financial compensation for your emotional distress and physical pain.

In rare cases, we might also seek punitive damages as a form of punishment. Florida law allows them when a defendant intentionally injures someone or who acts with conscious disregard for other people’s safety.

How to Prove Fault in a Pompano Beach Car Accident

If you seek to hold someone else accountable, you need to prove fault for the crash. This step requires solid evidence of how the accident happened and who is to blame. Most commonly, another driver caused an accident because they were driving negligently:

  • Distracted driving
  • Texting and driving
  • Talking to a child in the backseat
  • Driving while chemically impaired
  • Drowsy driving
  • Failing to yield
  • Failing to use a turn signal
  • Tailgating
  • Driving on the sidewalk
  • Illegal turns

Unless the other driver admits to making a mistake, you have the problem of proving negligence. That means relying on evidence. Our legal team knows how to seek relevant evidence like cell phone records, which might show the driver was on the phone in the moments before a collision. Other evidence includes witness testimony that the driver was driving dangerously.

What Steps Should You Take Following a Crash?

We strongly recommend that accident victims follow this checklist. These steps improve the chances that you make a full recovery and strengthen your claim for compensation.

1.       Stop your car immediately. Some collisions immediately disable a vehicle. If not, you should stop immediately because the law requires it.

2.       Ask if anyone needs an ambulance. Some victims are in immediate danger and need an ambulance.

3.       Report your collision to the police. Use your cell phone and report the crash. An officer should come to the scene of the accident.

4.       Swap information with other drivers. Now is the time to get insurance information, as well as the driver’s name, license number, and address. This information makes submitting an insurance claim easier, and it’s harder to obtain this information once everyone leaves the accident scene.

5.       Reach out to witnesses. Some people who saw the accident will stop to help. These could be other drivers on the road or pedestrians who saw the collision downtown. You should try to speak to as many witnesses as you can.  Ask them what they saw and if you can have their name and phone number or email.

6.       Take pictures of the scene, including all vehicles. We would like to see the condition of the cars after the crash, as well as where they ended up. Walk around each car (if you can) and take photographs of any dents. Pay attention to where the cars impacted each other.

7.       Visit the hospital when you are finished at the scene. Going to the hospital helps start a paper record of your injuries. Tell the doctor where you feel pain.

8.       Hire a personal injury lawyer as soon as possible. Your lawyer will provide targeted advice and keep insurance adjusters from bothering you. It is never too early to schedule a free consultation with a lawyer.
