Jury Awards $40.5M in Massachusetts Lung Cancer Wrongful Death Trial

A Massachusetts jury awarded $40.57 million against Philip Morris and R.J. Reynolds, finding their cigarettes defectively designed and responsible for Jose Amaral’s fatal lung cancer. The award includes substantial punitive damages due to the companies’ distribution of cigarettes that were defective and unreasonably dangerous when safer alternative designs were available.  Amaral, who died in 2019 at age 54, smoked for over three decades.
