Frequent Car Accident Injuries

- Shoulder injuries
- Joint dislocations
- Strains and sprains
- Muscle tears
- Burns
- Lacerations or abrasions
- Head injuries
- Concussions and traumatic brain injuries
- Whiplash
- Back injuries
- Spinal column injuries

- Crush injuries

- And more!
Florida’s Personal Injury Protection (PIP) Insurance
Florida is one of the few “no fault” states in the country. Under this system, accident victims first turn to their own PIP insurance for compensation. The Sunshine State requires all motorists to carry at least $10,000. If you don’t have a policy, you might be covered under a family member’s.
These benefits can cover up to 80% of your medical bills and 60% of your lost income, up to your maximum policy limit. However, there are strings. You need to receive prompt care—within 14 days. If you don’t, you lose the ability to receive anything.
A motorist also needs an emergency medical condition as defined by law to receive the maximum available under the policy. PIP also provides no benefits for pain and suffering or emotional distress.
Can You Sue for a Car Accident?
The state lets you sue a defendant in certain situations. If you have a serious injury under Fla. Stat. § 627.737, you can bring a lawsuit for pain and suffering, along with economic losses. We often sue if our clients have suffered a permanent injury or substantial disfigurement or scarring.
To win a case, we need to prove fault, which means the person responsible for the crash. Under the law, someone else must be at least 50% to blame for the collision, otherwise you are prevented from suing.
Call DDRB today. Our South Miami car accident lawyers need to review all evidence and pull together a case on your behalf. We can analyze whether you are limited to PIP benefits or whether we can seek additional compensation from a defendant.
Car Accident Deadlines
Victims must file a lawsuit before the deadline spelled out in the relevant statute of limitations. Florida has recently shortened its deadline to two years for most personal injury cases, including car wrecks. The clock will begin when you are involved in the crash.
It is imperative that you call a lawyer quickly. Don’t go over this deadline. Judges are not sympathetic, and you will easily lose the ability to sue for compensation.
Our Car Accident Experience is Broad
South Miami sees all types of accidents. Our team of car accident attorneys can help with any type of collision, including:
- Head-on Collisions:
In a head-on collision, two vehicles moving in opposite directions collide front to front. The force generated in these accidents can lead to severe injuries due to the direct impact between the vehicles. - T-bones and Side-Impact Crashes:
T-bone or side-impact crashes occur when the front of one vehicle collides with the side of another. Intersections are common locations for these accidents, resulting in significant damage and often causing injuries to the occupants on the impacted side. - Sideswipes:
Sideswipes involve vehicles brushing against each other along their sides. Although they may seem minor, sideswipes can still cause damage and lead to accidents, especially if drivers lose control or react abruptly. - Rollovers:
Rollover accidents happen when a vehicle flips over onto its side or roof. These accidents are often associated with high speeds, sharp turns, or collisions that cause the vehicle to overturn, posing a high risk of serious injuries. - Rear-End Collisions:
Rear-end collisions occur when one vehicle crashes into the back of another. These accidents are common and can result in whiplash injuries for the occupants of the vehicle that was struck. - Drunk Driving Accidents:
Drunk driving accidents involve at least one driver operating a vehicle under the influence of alcohol or drugs. These collisions can be particularly devastating due to impaired judgment and delayed reaction times. - Distracted Driving Accidents:
Distracted driving accidents occur when a driver’s attention is diverted from the road. Common distractions include texting, talking on the phone, or other activities that take the focus away from driving, leading to increased accident risks. - Multiple Vehicle Pile-Ups:
Multiple vehicle pile-ups involve numerous vehicles colliding in a chain reaction. These accidents often occur in adverse weather conditions, such as fog or icy roads, and can result in complex liability issues. - Single Vehicle Accidents:
Single vehicle accidents involve only one vehicle and can result from various factors, such as driver error, mechanical failure, or environmental conditions. Despite involving only one vehicle, these accidents can still lead to serious injuries. - Hit and Runs:
Hit and run accidents occur when a driver involved in a collision leaves the scene without stopping to exchange information. Identifying and holding the responsible party accountable can be challenging in these cases. - Rideshare Accidents:
Rideshare accidents involve vehicles associated with ride-sharing services. Determining liability in these cases may involve factors such as the driver’s status (on or off duty) and the specific circumstances surrounding the accident.
We can also help non-motorists hit by a car, such as pedestrians, bicyclists, and motorcyclists. After any type of motor vehicle accident, please contact us.
An Overview of the Personal Injury Claims Process
The legal process is confusing for many people. Our clients are often struggling with intense pain and sleeplessness. They don’t have the time or energy to manage a personal injury claim, so they call us. Here is an overview of the case process:
- Evidence gathering at the scene. Your case begins as soon as someone strikes your vehicle. You should come to a complete stop and call the police to report the crash. Also exchange information with the other driver and take pictures of all vehicles involved. Also get a picture of anything that appears interesting, like a missing stop sign or a pothole which caused you to lose control. Talk to witnesses, as well.
- Receiving medical care. Injuries are serious, and you might need rehabilitation, multiple doctor appointments, and at-home rest. You should follow your physician’s treatment plan to the letter.
- Notifying your insurance company. Call to report the details of the accident—where and when. Don’t give a recorded statement or answer detailed questions, just call to open a claim.
- Consulting an attorney. You should meet with an experienced South Miami car accident attorney to go over what happened. Based on the information you share, the lawyer might agree you can file a lawsuit or they might explain what other additional information they need.
- Analyzing fault. If you have a serious injury or large expenses, then you might sue. Your lawyer can review all the evidence to identify fault. Often, another motorist is at fault for driving negligently (speeding, texting-and-driving, etc.), so they are legally on the hook for compensation.
- Negotiating a settlement. Our lawyers can draft a demand letter to explain how the accident happened and your injuries. We request a fair sum of financial compensation for you.
- Litigating a claim. Settlement rarely happens quickly, so we might need to file a lawsuit before the statute of limitations. We can present your case to a judge and jury, if necessary.
