When AI Gets It Wrong: New Medical Malpractice Risks in Modern Healthcare

Artificial intelligence is rapidly changing healthcare. From reading imaging scans to assisting with diagnoses, AI tools are now embedded in everyday medical decision-making. While these systems promise efficiency and accuracy, they are also creating a new and growing area of medical malpractice risk. When AI gets it wrong—and a provider relies on that mistake—the consequences can be serious.

One of the most concerning developments is something known as automation bias. This occurs when a medical provider places too much trust in an AI-generated result and fails to independently verify it. In theory, AI should support clinical judgment. In practice, it can replace it. When that happens, errors that should have been caught early may go unnoticed.

Recent cases show that AI-related medical mistakes are not rare. Radiology is one of the most affected areas. AI systems are often used to flag abnormalities in imaging scans. But these systems are not perfect. Tumors may be missed. Fractures may go undetected. Subtle findings can be overlooked entirely. When a provider accepts the AI output without question, a missed diagnosis can delay treatment and allow a condition to worsen.

Cancer cases are a major concern. A delayed cancer diagnosis can significantly impact survival rates and treatment options. In several emerging malpractice claims, patients were told imaging was normal, only to later discover advanced-stage cancer that had been present but not identified. These cases often center on whether the provider should have recognized the error, regardless of the AI system’s involvement.

AI is also being used in clinical documentation and treatment recommendations. Some systems suggest diagnoses based on patient symptoms or generate notes automatically. While this improves efficiency, it introduces new risks. Incorrect information can be entered into the record and then carried forward. Treatment decisions may be based on flawed data. Once an error is in the system, it can spread across multiple providers.

Another issue involves lack of transparency. Many AI systems operate as “black boxes,” meaning providers may not fully understand how a conclusion was reached. This makes it harder to identify when something is wrong. If a provider cannot explain the reasoning behind a diagnosis, it raises questions about whether proper medical judgment was exercised.

Responsibility in these cases is still evolving. AI does not replace the duty of care owed by a medical provider. The expectation remains that providers will use their training and judgment to evaluate all available information. Relying blindly on technology does not excuse a mistake.

These cases are highly fact-specific. Not every AI-related error leads to malpractice. The key issue is whether a reasonably careful provider would have questioned the result, ordered additional testing, or taken further steps to confirm the diagnosis.

As AI becomes more integrated into healthcare, the number of cases involving these systems is expected to grow. What was once a human error is now often a combination of human and technological failure.

When technology is used without proper oversight, the risk shifts—but it does not disappear. It simply becomes harder to detect until harm has already occurred.
