You were injured after renting a Jet Ski. Now what?

You just rented a Jet Ski while visiting one of South Florida's many beaches or resorts, when all of a sudden tragedy strikes and you or your child suffers a serious injury. Many questions start to rush through your head. What am I going to do? Should I call an ambulance? Who is going to pay the medical bills?

At first, you may think the company or resort that rented you the Jet Ski in the first place will help cover your expenses, but you have one problem: you signed a waiver and release of liability.

While a release may complicate a legal claim, it is important to remember that you may still be able to seek damages for your injuries depending on the circumstances of your accident and the specific language of the waiver. Indeed, even if you signed a release, companies and resorts that rent Jet Skis and other personal watercrafts may still be liable for injuries if:

  • The Jet Ski was unsafe, poorly maintained or knowingly defective
  • The rental company failed to provide proper safety equipment or safety instructions
  • The rental company allowed someone who was underage or clearly intoxicated to rent a Jet Ski, and this individual injured you or your child
  • The rental company's negligence injured your child, and you signed the release on your child's behalf

However, every situation is different. In fact, just because your accident involves one of the factors mentioned above, it does not guarantee you will be entitled to damages from the resort or company that rented you the Jet Ski.

This is one reason why it is so important to contact an experienced attorney right away. A skilled attorney can also help determine whether other legal options exist, including possible claims against other Jet Ski drivers or personal watercraft manufacturers.
