When Are Resorts Responsible For Injuries?

If you are injured while staying at a Florida resort, you may assume that the resort will pay for your medical bills and other expenses. Unfortunately, most insurance companies will not pay damage claims without a fight.

To recover compensation, you will need to prove that the resort was negligent in maintaining its property and that you were injured as a result. It often takes an attorney's help to receive the money you are due.

Under Florida law, property owners are responsible for providing a reasonably safe environment for guests. Examples of unsafe property conditions include:

· Broken or uneven steps

· Inadequate lighting

· Negligent security

· Tripping hazards

· Spills that create a slippery walking surface

· Falling objects

It's important to document both the hazardous condition and how long it existed without being corrected. To be liable, the resort owner must have aware of the unsafe condition (or should have been aware) and had time enough to fix it. Photographs and witness statements may be needed to prove your case.

If you can show that negligence on the part of the resort owner caused your injury, you are entitled to seek entitled to compensation for damages such as medical bills, lost wages, pain and suffering, and other losses. It's important to seek medical treatment for two reasons: so you will get better and so you have evidence of your injury.
