Delayed Diagnosis Of Cancer A Growing Problem

Under Florida law, doctors may be responsible for losses caused by delayed diagnosis or misdiagnosis of cancer. If your health care provider had an opportunity to diagnose your cancer but failed to do so, you may have the right to file a medical malpractice lawsuit against the health care provider.

Here are some examples of medical errors that could result in a finding of negligence against the health care provider:

· Failure to diagnose melanoma despite visible signs of a cancerous mole

· Failure to order appropriate tests that could diagnose cancer

· Failure of a lab technician to communicate lab tests results to your doctor

· Misdiagnosis of cancer symptoms

· Failure to detect breast cancer on an MRI image

Not every case of delayed diagnosis of cancer is due to medical malpractice. Sometimes doctors do everything they are supposed to do and still discover cancer too late for successful treatment. For example, if you fail to go to your doctor for routine physicals or fail to report symptoms of illness, your doctor may not be responsible. However, if your cancer diagnosis was delayed because your health care provider failed to meet the standard of care, you may have a case of medical malpractice against the provider.
