Holding Doctors Responsible For Medical Errors

If physicians are competent, careful, and make use of available technology to prevent mishaps, there is no excuse for them to err in prescribing medications for their patients, particularly when lives hang in the balance.

Dolan Dobrinsky Rosenblum Bluestein, LLP of Miami works to hold doctors accountable for prescription mistakes and other medical errors that lead to serious injury or death. Our experienced personal injury trial lawyers have had notable success in securing damages on behalf of victims and their families. We pursue rightful compensation for clients throughout South and Central Florida. Call 305-371-2692 for a free case evaluation.

Getting The Right Drug To The Right Patient

Physicians must be familiar with hundreds of pharmaceuticals with similar-sounding names. They may write dozens of prescriptions every day, with limited time to study patients’ drug histories. But because of the potential for catastrophic harm, they still owe a duty to their patients to be accurate and confident in every scrip they write.

Our Miami attorneys have the knowledge and access to medical experts to trace liability back to the responsible doctor for:

  • Prescribing the wrong drug, leading to adverse drug reactions;
  • Illegible handwriting or ambiguous abbreviations causing a nurse or pharmacist to give the wrong drug;
  • Failing to check for dangerous contraindications with other drugs the patient is already taking;
  • Failing to ask about or account for known drug allergies;
  • Recommending off-label (unapproved) use of medications;
  • Dosage errors; and
  • Failure to adjust medication.

In addition to prescription mistakes, our lawyers handle cases of surgical errorsmisdiagnosis and other types of negligence that results in harm to patients.

Our attorneys have extensive experience in medical malpractice cases, enabling us to plan strategies for negotiations or trial to secure the maximum compensation for our clients.

Doctor Exhaustion & Sleep Deprivation

If you’re exhausted after working an eight-hour day, think about how doctors in a hospital must feel. Many are required to work 30-hour shifts—that’s more than a day straight of work. Many work 100 or more hours in the course of a week. With only a few hours of sleep in between shifts, doctors are opening themselves up to medical malpractice lawsuits.

For medical residents, the number of consecutive hours they can work is currently set at 16—still twice the amount of hours in a normal workday. However, there is talk of bumping up that number to 28 consecutive hours. But why? The Accreditation Council for Graduate Medical Education (ACGME) finds that number acceptable based on new evidence and research.

It all comes down to dedication. Doctors feel that when they save lives by being sleep-deprived and overworked, they can be a hero. But it doesn’t always end up that way. In fact, the opposite is often true.

What the ACGME Says

Changes definitely have to be made, but it can be impractical to do so. In an inpatient environment, patients are in need 24/7. Doctors must coordinate multidisciplinary teams. Doctors are feeling more and more stress as they see more patients spend more time doing paperwork.

The ACGME is committed to physician well-being. The organization claims that residents have support available to them to deal with the effects of exhaustion. For example, patient care can be transitioned to other doctors when a resident is too tired. There is also a requirement that hospitals must provide transportation options and sleep facilities for fatigued residents.
